Terms & Conditions

1.    Cleaning

The premises are available from 2.00pm on the day of arrival and are to be vacated no later than 9.30am on the day of departure. The premises are to be left in a clean and tidy condition. Please ensure that dishes, pots and pans etc are washed and put back into cupboards. Rubbish put into appropriate provided rubbish bins. No furniture is to be moved during your stay. Failure to do either of these will incur a charge, which will be deducted from your security deposit. If a BBQ is provided, a cleaning fee will apply if not left clean. Tenancies under 8 weeks the landlord is responsible for laundering linen & cleaning of the property, however any tenancies beyond 8 weeks the tenant is responsible for having the premises professionally cleaned (cleaner as nominated by our office), linen professionally laundered & where necessary carpets professionally steam cleaned, to be charged to the tenant.

2.    Cancellation

Will result in forfeiting one week’s rent deducted from security deposit

3.    Security Deposit
Security deposit is equivalent to one week’s rent; this will be paid towards the bond which is equivalent to four weeks rent and is required prior to collection of keys, the security deposit will be forfeited if cancellation occurs. Keys will only be released upon full payment of bond & two weeks rent paid. Preferred method is credit card (surcharges apply, Amex & Diners not accepted). Following a successful inspection of the premises at completion of tenancy, the security bond will be returned within seven days. Your security bond will be refunded in full, providing that upon inspection of the premises directly after departure, they are found to be in order. Bushby Property Group reserves the right to withhold the security deposit or part thereof, if: (1) An additional clean is required (2) Damages have occurred to the property (3) The accommodation is not paid for and (4) undue noise at the property. Guidelines for security deposits: Property left clean and tidy, dishes washed, dried and put away, dishwasher emptied, stove clean- no spillage, no rubbish other than in the wheelie bins provided, no marks on the carpet, property left secured- windows closed, doors locked. Furnishings that are removed, become damaged, stained or suffused with cooking smells or other odours will result in the tenant incurring additional costs to cover the cost of repair, replacement or specialist cleaning of such item. If you leave the property in the same condition you found it and did not disturb the peace, there should not be a problem with having your Security Bond refunded in full. This office reserves the right to list tenants who leave properties in state of disrepair or filthy to TICA (Tenants Information Centre Australasia), as well as seeking payment via a collection agency eg Tasmanian Collection Service or VEDA.

4.    Condition of Premises

All damages, breakages or losses to the property, furniture and furnishings are to be reported to the agent and paid for by the tenant immediately. Otherwise costs will automatically be deducted from the security deposit. Should you discover a default or breakage when you arrive please advise or we will consider those the responsibility of the current tenant and charge accordingly. If there are any signs of tampering with the owners private cupboard on departure it will be treated as break and enter and will be dealt with accordingly.

 5.    Keys

Keys are to be collected from our office on commencement date  – Monday to Friday 8.30am – 5.00pm. Saturday 9.00am – 11.30am. One set of keys only will be issued per property. Should you require after hours key collection, please advise us prior to your commencement date to arrange key collection at a nominated spot. Keys will only be left out for collection if full payment (2 weeks rent & security deposit) are paid in & all documentation has been signed & returned to our office.

Lost keys – A $60 cash fee will be charged if the agent is called out after 5.30pm Monday to Friday & Saturday after 12 pm, due to misplaced or lost keys. Because of security reasons we are unable to provide a call out service for keys after 9.00pm. If keys are lost all locks must be changed at a cost charged accordingly by the locksmith to the tenant.

6.    Insurance

No responsibility is taken for tenants personal property left on the premises. Tenants must be aware that their goods are not covered by any insurance taken out by the owner, and they have to take out their own cover if they want insurance for their goods. The tenant shall not do or allow anything to be done which would invalidate any insurance policy on the premises or increase the premium and the tenant shall pay to the owner all increased premiums and all other expenses incurred as a consequence of any breach of this term.

The tenant agrees to pay the owner any excess amount charged, or any additional premium charged by the owners Insurance Company as a result of accidental breakage of glass, toilet bowls and wash basins in the premises where the damage has been caused by the tenant, or by anyone on the premises with the consent of the tenant.

7.    Body Corporate Rules

Strata Title Law & Body Corporate Rules must be observed. Please note you are in a residential area and regard must be paid to quiet enjoyment of surrounding neigbours & other occupants in the complex or nearby buildings. No person on the premises shall be guilty of conduct that is a nuisance to adjoining or neighbouring occupiers. In home units Strata Title by-laws and regulations must be observed. Only one warning following a noise complaint will be given. Any further complaints will result in immediate eviction of the premises with no refund.

8.    Sale of Premises by Owner

In the event the property is offered for sale, the tenant agrees to allow the owner or his agent to inspect the property with prospective purchasers with 48 hours notice between the hours of 8am & 6pm Monday – Sunday. The agent can not be held responsible should the property be sold.

9.    Property not Suitable

No provision can or will be made for relocation, if accommodation is deemed unsatisfactory on arrival other than on the basis that the full rental due be forfeited and full rental on new premises is paid prior to occupancy. Tenants must accept premises “as applied for” and can not be relocated. We are careful not to misrepresent any rental property. NO REFUND IS GIVEN IF YOU ARE NOT SATISFIED WITH YOUR ACCOMMODATION.

10.  Property Maintenance & Repair/Replacement Works

The agent endeavours to have any repairs to appliances attended to as soon as possible after reporting of same. However, due to unforeseen circumstances (eg having to order parts or non-availability of tradespeople) the immediate repair may be beyond our control. No responsibility is accepted by the agent for these unforseen circumstances. There will be no refund or discounts deducted from rental rates for unusable appliances awaiting repair. Tenants accept responsibility for blockage in any septic system. Eg no foreign objects to be placed in the toilet

11.  Pets

Pets are not permitted on or inside the premises. If a pet is found to be on the property no responsibility will be taken by Bushby Property Group or the landlord for the welfare/safety of the animal and should the animal do any damage the tenant is responsible for full replacement/repair/clean.

12.  Utilities

Tenancies 8 weeks & under may include an electricity tariff capped at $30 per week during warmer months & $50 per week during cooler months, usage exceeding this the tenant will be charged for this. Tenancies beyond & or extending 8 weeks, the electricity will be the full responsibility of the tenant. Charged accordingly by our office, as confirmed by Aurora Energy. For long term tenancies, 8 weeks & above, the tenant must pay all charges in respect of gas, electric light and power, telephone calls (rental and installation) and all other charges levied by any competent authority providing services to for or on behalf of the tenant.

13.  Notice to inspect the Property
After an initial 8 week tenancy, we are permitted to enter the premises to conduct a routine maintenance inspection. With consequent inspections thereafter every 3 months. Prior written notice will be provided to the tenant, allowing 48 hours notice.

14.  Misconduct
The operation of business of any kind from the rental premises is strictly prohibited & in breach of these terms & conditions & will result in immediate eviction.

15.  Non Smoking

Smoking is not permitted. Accordingly, should the tenant or tenants guests smoke in the property, the tenant will be liable and bear all costs associated with removing odour from the property and fixtures & furnishings, not limited to steam cleaning carpets, furniture and window coverings.

16.  Payment Terms
Rent must be paid in advance as from the commencement date until the agreement is validly terminated. A itemized tax invoice that includes rent for the coming period plus any additional service charges, will be issued and payable on or before the due date and is then payable in advance of the rental period detailed on the tax invoice. If a rental payment is rejected by a Financial Institution a fee of $25.00 is charged. If a cheque is dishonoured by a Financial Institution a fee of $30.00 is charged.

17.  Notice to Vacate

The tenant shall vacate the property on the said completion date. Two full week’s notice prior to vacate date is required to advise whether extending tenancy or vacating. Bushby Property Group will otherwise assume that the completion date is the date of vacating & will make necessary arrangements for cleaning & showing future prospective tenants. Should the tenant wish to vacate prior to the completion date, the tenant will be liable for continuing to pay the rent & other charges until such time as a suitable replacement tenant is found. Additional costs will be incurred for breaching the terms & conditions & schedule.

18.  Servicing

Regular ongoing servicing of the property for duration of tenancy is strongly recommended. Servicing includes; vacuuming, launder linen, bathroom clean & kitchen surface wipeover. Does not include; washing dishes or personal clothing.
